DMCA Policy

Whats In Season June respects the intellectual property rights of others and expects its users to do the same. This policy is designed to address claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Whats In Season June service, please notify our Copyright Agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information when providing notice of the claimed copyright infringement:

Filing a Notice of Copyright Infringement

  1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material that is claimed to be infringing and where it is located on the Whats In Season June service. This must be specific enough to allow us to locate the material (e.g., provide the URL of the infringing page or specific posts).
  4. Information reasonably sufficient to permit Whats In Season June to contact you, such as your address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or law.
  6. A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Counter-Notification Procedures

If you believe that your content was removed or disabled by mistake or misidentification, you may send us a counter-notification. For your counter-notification to be valid under the DMCA, you must provide the following information:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to jurisdiction of any judicial district in which Whats In Season June may be found), and that you will accept service of process from the person who provided notification under DMCA subsection (c)(1)(C) or an agent of such person.
